SOUTH AFRICA
Property development: Advised a client in a dispute with its contractor, arising out of a JBCC agreement relating to the construction of the Pearls of Umhlanga in Kwa-Zulu Natal.
Mining: advised a client on its termination right under a FIDIC agreement for the construction of a facility located within a coal mine. We assisted with the amicable settlement of the dispute between the parties and closing out the contract.
Infrastructure: advised in adjudication proceedings arising out of an NEC3 engineering and construction contract for the rehabilitation of runways at O R Tambo International Airport.
Energy: advised in relation to a tender submitted to the City of Cape Town in relation to a hydro-electric power station at the Steenbras Dam.
Mining: advised a coal mining client in relation to the tender for the construction of a dam.
Construction: standerdised the special conditions for NEC3 engineering and construction contract, NEC3 professional services contract, and the General Conditions of Contract for Construction for a state-owned airports management company.
Energy: advised in a delay and disruption claim arising out of the Kusile Power Project.
Energy: advised in relation to disputes arising out of the Karusa and Soetwater Wind Farm Projects.
Mining: advised in relation to submitting a tender for the provision of operation and maintenance services at an iron ore mine.
Construction: advising a subcontractor in the recovery of amounts due in terms if an NEC3 Professional Services Contract relating to the repair and maintenance of a standby generator plant at a district municipality in the Northwest.
Infrastructure: standardised the special conditions for NEC3 suits of contracts, and the latest edition of the General Conditions of Contract for Construction for a state-owned airports management company.
Energy: advised in relation to back-to-back subcontracts for a manufacturer and supply of photovoltaic panels pursuant to South Africa’s Renewable Energy Independent Power Producer Procurement Programme (REIPPPP).
Construction: advised in relation to claims arising out of a subcontract for the supply and installation of an HVAC system for the construction of a mall in Limpopo.
Transport and logistics: advised in various adjudication and arbitration proceedings arising out of various NEC3 term services contracts for railway maintenance services to be provided across South Africa.
Mining: advised on EPCM and various other construction, mining service and supply agreements relating to the Merensky Concentrator Plant Project in Limpopo.
Construction: advised in relation to the recovery of amounts owed to a contractor pursuant to the services rendered in terms of a civil and electrical contract in the Balfour Wastewater Treatment Project.
Hospitality: advised on a dispute arising out of a JBCC agreement for the provision of various construction maintenance works at a major national park.
Mining: advised client on its rights and remedies under a goods and services agreement, following an accident on site involving defective equipment supplied to it by a contractor.
Infrastructure: advised and represented a state-owned airports management company in adjudication proceedings instituted by its professional consultant for delays and disruptions arising out of an NEC3 Professional Services Contract.
Mining: advised a client in relation to various FIDIC agreements for construction at its open pit coal mining project in Mpumalanga.
Construction: advised on a specific performance claim in relation to outstanding works at a secondary school in Limpopo.
REST OF FRICA
Energy: advised a Mauritian client on a dispute arising out of a subcontract agreement for the mechanical installation works for the Kinyerezi 1 Extension project in Tanzania.
Infrastructure: advised on a dispute arising out of an agreement for the Final Construction Phase of the Maternity and Newborn Hospital in Tanzania. We assisted with making submissions to the National Construction Council in Dar Es Salaam.
Infrastructure: advised on a claims and dispute arising out a back-to-back subcontract for a FIDIC/EPC/Turnkey agreement relating to an infrastructure project in Burundi.
Infrastructure: advised on claims arising out of the construction of the Gatuna One Stop Border Post between Uganda and Rwanda.
Energy: advised on EPC and O&M agreements to be concluded in relation a photovoltaic power plant located near Kwekwe in Zimbabwe.
Mining: advised advising client on its termination rights under an agreement for the supply and delivery of goods to a platinum mine in Zimbabwe.
Energy: advised in relation to Namibia’s Renewable Energy Feed-in Tariff (REFIT) programme.
Technology: Advised a multinational contractor in managing and resolving claims under back-to-back contracts between the client and its subcontractor and its employer. The agreements related to the cross-border supply and installation of e-Houses on a project for the construction of a thermal power station in Ghana. The agreements were based on FIDIC.
Mining: advised in relation to the cross-border supply of commodities to a diamond mine in Botswana.
Construction: advised in relation to a tender to develop under a PPP, a bus interchange, a farm produce wholesale market, a farm produce retail market, a flea market, shopping mall and budget hotel, as well as commercial offices, a shopping mall and a Civic Centre in Harare, Zimbabwe.
Rail: Advised a state-owned rail, port and pipeline company providing rail refurbishment and maintenance services in various jurisdictions including Columbia, Angola and Gabon.
Infrastructure: advised on claims and disputes arising out of a back-to-back subcontract for a FIDIC/EPC/Turnkey agreement relating to an infrastructure project in Burundi.
Mining: advised in relation to the manufacturing and cross-border supply of goods to a platinum mine in Zimbabwe.
Construction: drafted various agreements pursuant to a project for the development of the Harare Municipality in Zimbabwe. The client was awarded a tender to develop under a PPP, a bus interchange, a farm produce wholesale market, a flea market, shopping mall and budget hotel, as well as commercial offices, and a Civic Centre.
